A noise survey is normally required for new developments that have a likelihood of creating a noise nuisance in existing residential properties. A survey would allow the Local Planning Authority’s environmental protection unit to decide if the development is suitable, or whether adequate measures such as Environmental Monitoring are in place to prevent noise pollution.

Control of Pollution Act (1974)

The Control of Pollution Act (1974) gives Local Authorities (LA) powers to control noise from Construction sites, and Loudspeakers in the Street. The Act also gives the Secretary of State power to issue Codes of Practice for minimising noise.

Section 60 and 61 Orders

Section 60 of The Control of Pollution Act gives Local Authorities powers to control noise on or from construction sites. Section 61 of the Act gives developers the ability to apply for prior consent for their methods of operation on construction sites.

Environmental Pollution Act (1990)

The Environmental Pollution Act (EPA) allows for the control of Statutory Nuisance. A Statutory Nuisance is the collective term for all nuisances to which Parliament has chosen to apply summary abatement procedures and includes some things which would not otherwise constitute either public or private nuisance in common law. Noise and Vibration can constitute nuisance within the terms of the EPA (1990) as amended by the Noise and Statutory Nuisance Act 1993.

BS5228 Code of Practice: Noise Control on Construction and Open Sites

BS 5228 contains detailed advice on the control of noise and vibration from construction sites. Part 1 of 5228 deals with controlling noise. Advice is proposed for: General Issues, Noise and Persons on Site, Noise and Neighbouring Nuisance, Project Supervision and Control of Noise. Annex E suggests several methods of assessing noise levels from construction projects. Note is made that these only apply to projects of a significant size. Annex F of BS5228 describes a method of predicting noise levels from plant at the boundary of a construction side.
